Who is Affected?

It is crucial to understand that this policy is specific to both nationality and visa route.

  1. Affected Nationalities: Nationals of Afghanistan, Cameroon, Myanmar, and Sudan.

  2. Affected Routes: * Student Visas: Main applicants from all four countries (Afghanistan, Cameroon, Myanmar, and Sudan).

    • Skilled Worker Visas: Specifically main applicants who are nationals of Afghanistan.

Note: This brake applies to out-of-country applications only. If you are already in the UK lawfully, your current permission to stay remains valid, and you may still be eligible to switch routes within the UK.

Key Deadlines and Enforcement

The timeline for this change is strict. If you are a national of one of the affected countries, here is what you need to know:

  • Before March 26, 2026: Applications submitted online before this date will be processed under the current Immigration Rules. If you hold a valid Confirmation of Acceptance for Studies (CAS) or Certificate of Sponsorship (CoS), you must submit your online application immediately.

  • On or After March 26, 2026: Any new out-of-country application submitted online will be refused, even if a CAS or CoS was previously issued.

Exemptions: What remains unchanged?

Not all visa routes are subject to this new measure. The UK government has confirmed that the visa brake does not apply to:

  • Child Student Visas or Short-Term Student Visas (English language study).

  • Visit Visas: Individuals seeking to visit the UK for tourism or short-term business are not affected.

  • Dependants: If a main applicant is not from an affected nationality, they can still bring a dependant who is a national of an affected country.

  • Dual Nationals: Only the main nationality indicated on the application form is considered.

Essential Information for Sponsors and Employers

For education providers and UK employers, this policy requires immediate administrative attention.

  • BCA Impact: If an applicant is refused due to the visa brake, it may affect the sponsor’s Basic Compliance Assessment (BCA).

  • Withdrawal of CAS/CoS: Sponsors are advised to consider withdrawing any CAS or CoS issued to affected nationalities if the individual is unlikely to apply before the March 26 deadline.

  • Fees and Refunds: While the Immigration Health Surcharge (IHS) and Immigration Skills Charge (ISC) may be refunded upon refusal, the visa application fee itself will not be refunded for applications submitted after the brake is in force.
